Key Legal Considerations
Registration Requirement
Mandatory for property transactions (Registration Act 1908). File at the Sub-Registrar Office with:
Original CNICs of both parties.
Witnesses’ CNICs.
Payment of stamp duty (varies by province).
Protection Against Fraud
Biometric Verification: Attach NADRA-verified thumb impressions.
Video Recording: Optional but recommended for additional evidence.
Limited Scope: Avoid granting irrevocable or blanket financial powers.
Revocation Process
Execute a Revocation Deed with the same formalities (notarization + registration if needed).
Notify the Attorney in writing and publish a newspaper notice if fraud is suspected.
Brother-Specific Safeguards
Trust but Verify: Require periodic updates on property dealings.
Exit Clause: Add a clause like: "This GPA shall automatically terminate if the Attorney misuses authority."
