Key Legal Considerations

  1. Registration Requirement

    • Mandatory for property transactions (Registration Act 1908). File at the Sub-Registrar Office with:

      • Original CNICs of both parties.

      • Witnesses’ CNICs.

      • Payment of stamp duty (varies by province).

  2. Protection Against Fraud

    • Biometric Verification: Attach NADRA-verified thumb impressions.

    • Video Recording: Optional but recommended for additional evidence.

    • Limited Scope: Avoid granting irrevocable or blanket financial powers.

  3. Revocation Process

    • Execute a Revocation Deed with the same formalities (notarization + registration if needed).

    • Notify the Attorney in writing and publish a newspaper notice if fraud is suspected.

  4. Brother-Specific Safeguards

    • Trust but Verify: Require periodic updates on property dealings.

    • Exit Clause: Add a clause like: "This GPA shall automatically terminate if the Attorney misuses authority."
